Tempur Sealy & Mattress Firm File to Pause FTC Case

Tempur Sealy recently filed a request asking a federal judge in Texas for a preliminary injunction to halt their Federal Trade Commission (FTC) court proceeding, the FTC is attmpting to block the acquisition of Mattress Firm by Tempur Sealy for $4 billion.
On Oct 3, Tempur Sealy & Mattress Firm filed a corrected motion asking the FTC to continue the administrative evidentiary hearing to February 9, 2025 (which falls on a Sunday). Tempur Sealy & Mattress Firm argued that the later hearing date would give the federal court time to decide whether to issue a preliminary injunction before the administrative hearing begins and would reduce burdens on the parties involved because of litigation happening at the same time, including administrative proceedings and the evidentiary hearing.,
The motion that Tempur Sealy filed requesting a continuance for their Evidentiary hearing was granted and was moved to February 10 of next year.
Both parties were also directed to submit a joint status report or separate status reports on January 13, 2025, regarding the status of the federal court proceeding and its impact on whether (and when) an administrative evidentiary hearing may be necessary.
All of these motions and hearings are continuing the drama that has continued since the FTC filed their suit to try and keep the merger from happening. It will delay the next step in the proceedings until the new year.
