Victims of an online furniture retailer who didn’t deliver product purchased from the website will receive portions of a $50,000 as part of a settlement agreement with the Philadelphia Attorney General.
The settlement is with Matthew Kolodesh and Nellie Tsan, owners of MIG Enterprises Inc., which operated under the name Furniture XO.
Kolodesh will pay $15,000 in restitution, and Tsan, also of Salada Enterprises, will pay $35,000 in restitution for consumers.
Restitution will be awarded to consumers who filed complaints with the Bureau of Consumer Protection prior to the filing of the settlement, and within 90 days of the court approving the settlement.
Kolodesh agreed not to operate or control any company from a location in Pennsylvania or any company outside of Pennsylvania that would deal with Pennsylvania consumers.
According to the lawsuit filed in July, Furniture XO suffered cash flow problems resulting in the defendants using money from new customers to pay for orders placed with suppliers to fulfill orders from earlier customers.
