Cost Plus, Oakland, Calif., is trying to prevent World Market Center in Las Vegas from using the “World Market” in its operations and promotions.
Cost Plus Management Services said in a complaint filed in U.S. District Court in February that World Market Center infringes on the name of its chain of Cost Plus World Market stores, which total 286 stores in 35 states according to court documents.
Cost Plus said the U.S. Patent and Trademark Office has issued 23 federal registrations to World Market for World Market and Cost Plus World Market that include “World Market,” “World Market & Globe Design,” “Cost Plus World Market” and other variations.
Cost Plus World Market’s complaint seeks statutory damages of up to $1 million on each “counterfeit mark per type of services and/or goods sold or offered for sale by the defendant.”
A Cost Plus spokesman did not return a phone call Friday requesting information, and World Market Center declined to elaborate on the ongoing issue.
“We are actively engaged in efforts toward finding resolution of the matter; and therefore, it would be inappropriate to make any further
comment at this time,” said Dana Pretner Andrew, director of marketing and public relations at World Market Center via e-mail.
In December, World Market Center itself filed a complaint in Clark County District Court against Las Vegas retailer Dreamscape Inc., alleging the retailer sent a letter to customers indicating the store would change its name to “World Market Liquidators” and provide WMC products to the public at wholesale prices.
WMC sought an injunction against Dreamscape’s use of the “World Market Center” and “World Market Center Las Vegas” marks.

Outdoor furniture manufacturer and rep William Lyon and retailer Catherine Galbreath will receive 2007 Lifetime Achievement Awards from the Casual Furniture Retailers Association and the Summer and Casual Furniture Manufacturers Association on September 20 at the 48th Annual Apollo Awards Banquet in Chicago.
CFR and SCFMA developed the Lifetime Achievement Award to recognize individuals who have made exemplary contributions to the casual furniture industry and to their communities.
Lyon’s 52-year career started as sales office manager at Woodard, Owosso, Mich. He helped launch Carolina Forge, Salisbury, N.C., in 1959. When Woodard was purchased by Wicks Corp. in 1968, he founded Lyon-Shaw and sold it to Meadowcraft in 1987. He continued working for Meadowcraft through 1990, when he launched an independent representatives organization that represents companies such as O.W. Lee, Cast Classics and Pride Family Brands.
Galbreath joined ABSCO Fireplace & Patio in 1971 to help her husband, John, and added outdoor furniture to the store in the mid-70s. ABSCO now operates three stores. Galbreath joined the Casual Furniture Retailers soon after its inception and served on its board for six years.

Longtime furniture industry executive Alan Cole will return to the industry in mid-July when he joins Hooker Furniture Corp. as executive vice president of upholstery overseeing Bradington-Young and Sam Moore Furniture.
Cole, who has held senior executive positions at leading upholstered furniture companies including Broyhill, Berkline and Schnadig, “has the expertise in upholstery that uniquely qualifies him to help us realize one of our strategic objectives, which is to become a more important and complete upholstered furniture resource,” said Paul Toms, chairman, chief executive officer and president of Hooker. “We are excited to have someone of Alan’s caliber, intellect, character and industry experience join our organization.”
Under the new management structure, Scott Young, president of Bradington-Young, and Mike Moldenhauer, president of Sam Moore, will report to Cole.
Most recently, Cole was president and chief executive of Chicago-based Schnadig Corp. from 2004 to 2006, and was a member of the Hooker Furniture board of directors in 2003.
In addition, Cole has served as president and chief executive officer of two of the industry’s largest furniture companies and was a partner in Berkline where he was president from 1991 until 1996. He was president and chief executive officer of Lifestyle Furnishings International from 2000 to 2001.
In addition to overseeing the operations of Sam Moore and Bradington-Young, Cole will help develop growth plans for Hooker’s imported accent chair product line. He also will be involved in strategic planning for the company and will oversee any future acquisitions of upholstered furniture operations.
“It’s a great honor to rejoin the Hooker team,” Cole said. “Hooker’s history of partnership with its customers; industry and community citizenship; and its genuine respect for its people make this a natural decision for me. I’m eager to bring helpful and complementary skills and experience to this highly capable organization.”
